We grant use of and access to this website, its content and its services only to those who accept these Terms. You are contracting solely with System Switch Digital Ltd. No director, officer, employee, contractor or licensor of the company is a party to these Terms or bears any personal liability under them.

Age restriction

You must be at least 18 years of age to use this website. By using it, you warrant that you are at least 18 and can lawfully enter into these Terms. We accept no responsibility for liabilities arising from any misrepresentation of age.

Intellectual property

All materials, content, products and services on this website - including the System Switch name and brand, text, graphics, frameworks, methods, software, and all copyrights, trade marks, trade secrets and other intellectual property - are owned by or licensed to System Switch Digital Ltd. They remain our property (or that of our licensors).

We grant you a limited, non-exclusive, non-transferable and revocable licence to access and use the website and its content for your own personal, non-commercial purposes only. You agree not to reproduce, republish, resell, sublicense or redistribute our intellectual property in any form without our prior written permission.

Where you upload or submit content to us, you grant System Switch Digital Ltd a royalty-free, non-exclusive licence to use, store, copy, display and transmit that content for the purpose of providing and promoting the service. You confirm you have the right to grant this licence. For any intellectual-property query or claim, contact us so we can resolve it.

Services and purchases

This website is primarily an information and enquiry service. Any paid engagement you enter into with us - for example a reactivation build, system install or other service - is governed by a separate written agreement between you and System Switch Digital Ltd, which sets out the scope, fees, timelines, any guarantee, and data-processing terms. In the event of a conflict between that agreement and these Terms, that agreement prevails for the services it covers.

If and when we sell digital products or subscriptions through a store (for example store.systemswitch.digital), those sales will be subject to additional terms presented at the point of purchase, including your statutory rights where you buy as a consumer.

No guaranteed results

Information, examples, estimates and calculators on this website (including any figures you generate using our tools) are provided for general guidance only. They are illustrations, not promises or forecasts, and individual results depend on factors outside our control. Nothing on this website is financial, legal or professional advice, and nothing on it constitutes a guarantee of any particular result. Any guarantee we offer applies only where it is set out in a signed services agreement, on its stated terms.

User accounts

If you register with us, you are responsible for the accuracy of the information you provide and for keeping your account credentials secure. You are responsible for all activity under your account. If you believe your account security has been compromised, tell us immediately. We reserve the right, at our sole discretion, to suspend or terminate accounts, and to edit or remove content, where we reasonably consider it necessary - for example for breach of these Terms.

Acceptable use

You agree not to use the website unlawfully, to attempt to gain unauthorised access to it, to introduce malicious code, or to use it in any way that damages, disables or impairs the website or interferes with others' use of it.

Limitation of liability

Nothing in these Terms excludes or limits our liability where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, and for any other liability that cannot be excluded or limited under the laws of England and Wales. Where you deal with us as a consumer, these Terms do not affect your statutory rights.

Subject to the paragraph above, and to the fullest extent permitted by law: we provide the website "as is" and "as available" and give no warranties that it will be uninterrupted, error-free, secure or free of harmful components, and we exclude all implied warranties to the fullest extent the law allows (this does not affect the statutory rights of consumers); we are not liable for any loss or damage arising from your use or misuse of the website; and we are not liable for any indirect or consequential loss, or for loss of profit, revenue, data or goodwill. Our total liability arising out of or in connection with your use of the website is limited to £100. Liability for paid services is dealt with in the separate services agreement, not here.

Indemnification

You agree to indemnify and hold harmless System Switch Digital Ltd and its directors, officers and employees against claims, demands, losses and reasonable costs arising from your misuse of the website or your breach of these Terms.

Governing law and jurisdiction

These Terms, and any dispute or claim arising out of or in connection with them or your use of the website, are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction to settle any such dispute.

General

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions continue in full force. Our failure to enforce any right or provision is not a waiver of it. Any provisions that by their nature should survive — including those on intellectual property, disclaimers, limitation of liability, indemnification and governing law — will continue to apply after your access ends. These Terms are between you and System Switch Digital Ltd; a person who is not a party to them has no rights to enforce them under the Contracts (Rights of Third Parties) Act 1999. These Terms (together with any separate services agreement and our Privacy Policy) are the entire agreement between us regarding your use of the website and supersede any prior terms.

We may update these Terms from time to time. We will post the current version on this page with the date above, and significant changes may also be notified by email. Your continued use of the website after changes take effect constitutes acceptance of the updated Terms.
